Assault charge teenager banned from island          7/8/12

A teenager was given two hours to get off the Western Isles today (Tuesday) or he would be remanded in custody by an island sheriff.

It follows an incident at the entrance road to the Stornoway Co-op around 8pm on Sunday night where two men received injuries. One was taken to hospital for medical treatment.

It is alleged that 18-year-old Donald Alexander Baxter Macphee punched, kicked and stamped the man about his face and body to his severe injury.

At Stornoway Sheriff Court on Tuesday Macphee pleaded not guilty and requested to be bailed on Lewis.

Lawyer Angus Macdonald insisted that Macphee was also attacked in the incident which involved a small number of people.

Hon Sheriff Iain Macleod initially refused bail and was going to remand him in custody.

Macphee then provided a mainland bail address and was released to 42B Alma Road, Fort William.

He is banned from returning to the Western Isles except for court appearances.

The sheriff refused a request to give him 24 hours to arrange his departure.

Hon Sheriff Iain Macleod said a strict condition was “you leave on the ferry at lunchtime today.”

Co-accused John Michael Hunter, 17, of 76 Parkend also denied the assault charge and was bailed under a 7pm to 7am nightly curfew.

Both men were ordered not to contact the injured man in any way including by text or Facebook. Trial was set for November.
