“Drunk in charge of a child” woman banished from islands   8/3/10

 

 

 

 

A woman who is accused of being drunk in charge of a child has been banished from the Western Isles.

 

It followed a car crash on Lewis just after 9 pm on Saturday night when an infant was said to be travelling in a car with Gavin Millar and Brenda Ann Stirling which was involved in a smash near the Keose junction in South Lochs.  

 

The 40-year-old female driver of the other car was taken to hospital by ambulance.

 

Emergency crews attended the accident and fire crews provided lighting at the scene and later cleared debris off the road.

 

Brenda Ann Stirling of Easter Ross was told to leave Lewis by Wednesday when she appeared from custody at Stornoway Sheriff Court yesterday (Mon).

 

The 43-year-old of 168 Milnafau, Alness, pleaded not guilty to being drunk in charge of a five year old infant by the Keose Junction in South Lochs, Lewis on Saturday.

 

She also denies that, despite having care responsible for a child, she exposed the youngster to possible suffering or injury by allowing it to travel in a car driven by a person who was likely to be unfit to drive through alcohol.

 

Depute fiscal Rhoda Geddes originally desired that Stirling leave the island as soon as possible but agreed to be flexible to allow her time to organise finances.

 

Stirling is not allowed to return to the island except for court appearances. Trial was set for May.

 

It is alleged that Gavin Millar of 7 Gead Gorm, Carloway, was driving on the wrong side of the road and hit the oncoming vehicle injuring its female occupant.

 

He is accused of causing a car accident at Keose by driving without due care and attention, crossing the centre line of the road and crashing into another car.  The charge also alleges he crossed the middle of the road and failed to dip his headlights to oncoming traffic at Cameron Terrace, North Lochs.

 

Millar, 39, is also accused of failing to provide a roadside breathalyser test to police as well as not giving two later breath tests at Stornoway Police Station to determine his alcohol level.

 

He pled not guilty to the three charges when he appeared from custody at Stornoway Sheriff Court today. He was released on bail on the strict condition that he does not drive. His trial was fixed for May.
